Legal Information
The information listed below is for your understanding and protection when purchasing Art, especially Indigenous Australian Art.
1.
Purchasing a piece of art awards you unencumbered ownership of the work itself which means you can give it as a gift, you can display it at home or at work. You can even resell the piece but please read further to understand resale royalties. You are allowed to take photographs of it for PRIVATE use, however you may not reproduce the work in any medium whatsoever, whether for commercial or non-commercial purposes. Copyright and Intellectual Property Rights remain with the Artist and gets handed on to their decendants upon their passing. You can of course negotiate with the Artist or Artist Represenative if they have one to purchase a License agreement that will meet your needs at the time of the sale or later down the track. Note all of Wangaba Roebourne Art Group Artists are represented by the Management of the group, please contact admin@wrag.com.au for all enquiries.
2.
Reselling artwork comes with rules. In Australia this falls under the Australian Government Royalty Resale Scheme and requires the seller or the sellers agent to report all commercial resales of $1000.00 or more. For more information please see/contact Copyright Agency Royalty Resale Scheme.
3.
Reproducing an Artists original piece falls into very dangerous territory and there are laws all over the world to protect the Copyright of Artists. DO NOT REPRODUCE any piece of art without first negotiating an agreement with the Artist or Artist representative. Wangaba Roebourne Art Group will pursue any breach of copyright to any of our Artists in a court of law.
It doesn't matter if you are a Not-For-Profit, you still need to negotiate an agreement or face legal action.
If you are worried that a piece of art has shown up in the background of a photo that kind of situation can also be included in any agreement so you do not breach Copyright laws.
